PRIVACY STATEMENT

1. Introduction
Pension Bakema processes information about individuals on a daily basis and complies with the law in doing so. Pension Bakema respects the privacy of the individuals whose information it receives and treats all information as strictly confidential. In this privacy statement, we explain which personal data Pension Bakema processes and for what purposes.

This privacy statement does not apply to the processing of personal data by third parties, such as companies and/or websites that offer travel or travel packages. We recommend that you read this privacy statement carefully.

2. Personal data
Pension Bakema processes various types of personal data for different purposes:

Guest administration – For booking an overnight stay at Pension Bakema, or for renting a meeting room, Pension Bakema requires your name, address, city, phone number, date of departure and arrival, and payment details. Additional personal data, such as your nationality or guest preferences, may be requested to provide our services. Health data will only be processed with your consent, for example, to offer access for guests with disabilities. These data are only used internally and are not shared with other organisations for commercial purposes.

(Direct) marketing – To offer deals that may interest you, we collect commercially relevant information, such as demographic data, through cookies. We may also collect information from third parties, including partners and social media sites, in accordance with your privacy settings on those sites.

Social media – Pension Bakema can be found on various social media platforms, such as Facebook and Twitter, and uses social media plug-ins on its website. When you click on one of these buttons and register with your social media account, information is shared with that social media site and may be shown on your profile. We may also obtain personal data when you use functions like a Facebook “Like” on our website or apps.

Competitions and promotions – When participating in a contest or promotion, we will ask for your name, address, and email address to notify winners, execute the campaign, and measure response.

Recruitment process – Data from job applicants are collected and processed via personal contact, post, email, and/or telephone. These include name, gender, contact details, cover letters, education level, and employment history. Data will be deleted no later than four weeks after the procedure, unless you consent to longer storage for future opportunities.

Employees – Pension Bakema processes employee personal data in accordance with employment contracts and legal requirements. See the employee handbook for details.

3. Recipients
We do not share your personal data with companies, organisations, or individuals outside Pension Bakema, except in the following cases:

Contract performance – Sharing is allowed if necessary to fulfil our contractual obligations, e.g., processing your booking or passing details to a bike rental company, restaurant, or spa included in your package.

External processing – Data may be processed by partners (IT providers, CRM and booking system managers) based on our instructions and under strict confidentiality and security.

Legal obligations – Data may be disclosed to comply with laws, government requests, or legal proceedings (e.g., police fraud investigations, tax audits, or municipal tourist tax checks).

Legal obligation
If a legal obligation requires us to do so, we will provide your personal data. For example, the police may request information from us in the context of a fraud investigation. Another example is that the tax inspector, pursuant to Article 47 of the Dutch General Tax Act, can demand all data necessary for tax assessment. Finally, the municipality may also request data in order to verify the tourist tax assessment. Pension Bakema makes agreements with the recipients of your personal data to ensure that these data are treated confidentially and are properly secured.

4. Retention period
We do not retain your personal data longer than necessary, unless we are under a legal obligation to keep your personal data for a longer period. Our basic principle is that we only store personal data for as long as needed to provide you with our products and/or services. After that, we will delete your personal data wherever possible. If you have provided your email address so that we can keep you informed about our services, we will retain your data for that purpose.

5. Transfer outside the EU
We may transfer personal data within the European Economic Area (EEA), which offers the same level of protection as the Netherlands.

Transfers outside the EEA will only occur with adequate safeguards, such as EU Commission–approved standard contractual clauses.

Types of cookies
We distinguish between functional and non-functional cookies. We always place functional cookies, as these are necessary for the proper functioning of the website. Non-functional cookies process personal data outside your direct view. They mainly enable us to improve our services. For example, they allow us to measure how often our website is used and what information visitors are looking for. We always ask for your consent before placing non-functional cookies.

Right of access
At your request, we will inform you in writing whether we process any of your personal data. When making your request, you must identify yourself by providing a copy of your driver’s licence or identity document. In our response, we will explain which personal data we have processed or are still processing, and provide you with a copy. We will also explain for which purposes the data are or have been processed, with whom the data are shared, how long they are expected to be stored, and what other rights you may exercise.

Correction or supplementation
If you have received access to the processing of your personal data, you may request us to correct inaccuracies or supplement incomplete information. We will provide a reasoned response to your request. If we proceed with a correction, you will receive an additional statement from us. This statement will also be sent to any recipients of your incorrect or incomplete data.

Erasure of data
You may request us to delete your personal data from our systems in one or more of the following cases:

  • the personal data are no longer necessary for the purposes for which we processed them;
  • you withdraw your consent for (further) processing, and there is no other legal basis for processing;
  • you lodge a substantiated objection, and there are no compelling reasons for not honouring your objection;
  • the personal data have been unlawfully processed by us;
  • we are required to delete your personal data on the basis of a legal obligation;
  • we have collected your data through mobile telephone or internet services.

Restriction of processing
If you have reported an inaccuracy or incompleteness in your personal data to us, you may request us to restrict processing while we handle your request. You may also ask us to restrict the processing of your data if you believe we are processing your data unlawfully, if we no longer need them, or if you have objected to (further) processing. After receiving your restriction request, we will only process the data with your consent or for compelling reasons (such as legal proceedings).

Transfer of digital data
If you have provided us with personal data in a structured, commonly used digital file format, and we have processed your data with your consent or in the performance of a contract with you, you have the right to request a copy of this data. In such cases, you may also ask us to send your data directly to another service provider.

Objection
You may object at any time to the processing of personal data relating to you. This applies in particular to profiles we have created based on your personal data. We will cease processing your data upon receipt of your objection, unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms.

If we process your personal data for direct marketing purposes, you may object to this at any time, and we will immediately cease the processing.

Exercising rights
If you wish to exercise one or more of the rights listed above, you can contact us via the email address info@pensionbakema.nl. Pension Bakema will decide on your request within 4 weeks, unless we inform you within that period that we need a little more time.

Are your personal data being processed on the basis of your consent? Then you have the right to withdraw your consent. Any withdrawal of your consent does not affect processing carried out prior to the withdrawal.

8. Liability
Despite the care and attention devoted to managing this website, it is possible that the site contains incorrect information. Pension Bakema cannot be held liable for technical or editorial errors that appear on this website, nor for any consequential damages resulting from the use of, or the temporary unavailability of, this website or the links to third-party websites.

9. Complaints
Do you have a complaint about the use of your personal data? We would like to inform you about the complaints procedure of the Dutch Data Protection Authority (Autoriteit Persoonsgegevens). This authority is authorised to handle your complaint.
